These Terms & Conditions govern your use of the Resurgence Treks website and any reservation, purchase, or trek service booked through it. By using this website or placing a reservation, you agree to these Terms.

1) Services Provided

Resurgence Treks provides guided trekking services in Nepal and related support services, which may include permits, local guiding teams, accommodation coordination, and route logistics depending on the trek and package described on the trek page.

The exact inclusions and exclusions for each trek are listed on the relevant trek page.

2) Eligibility & Traveller Responsibility

By booking, you confirm that:

  • You are at least 18 years old (or accompanied by a legal guardian).
  • You understand trekking involves physical exertion and remote conditions.
  • You will follow guide instructions for safety and group management.
  • You will disclose relevant medical conditions that may affect safety at altitude.

You are responsible for arriving in Nepal with appropriate documentation (passport, visas, etc.) and for complying with local laws and regulations.

3) Booking & Payments

Reservations may be made by:

  • paying a deposit, or
  • paying in full

Deposit amounts and pricing are displayed on the trek page or at checkout.

Where a price range is shown, the final total may vary based on dates, group type, and logistics. Final pricing and the confirmed plan are provided after reservation and before any balance payment is due.

4) Deposits, Transfers, Cancellations & Refunds

Booking outcomes relating to deposits, transfers, cancellations, and refunds are governed by our Booking & Payment Terms and form part of these Terms & Conditions.

In summary:

  • Deposits are deductible from the final trek cost.
  • Deposits are refundable if we cannot confirm your trek for your preferred dates.
  • Deposits are transferable when cancellations occur outside the stated time windows, and subject to committed logistics closer to departure.

5) Itineraries & Changes

Trek itineraries may be adjusted due to:

  • weather conditions
  • flight disruptions (including Lukla)
  • trail or safety conditions
  • acclimatisation requirements
  • group pacing realities
  • operational requirements in remote areas

We do not guarantee rigid adherence to published day-by-day outlines. Our priority is safe, practical decision-making on the ground.

6) Weather, Delays, and Uncontrollable Events

Mountain regions are subject to disruptions beyond our control, including flight delays, road closures, political events, strikes, natural hazards, or changes to permit requirements.

Where disruptions occur:

  • We will advise the most practical options available at the time.
  • Additional costs (e.g., extra accommodation, transport changes) may apply.
  • We are not responsible for costs caused by third-party delays or uncontrollable events.

7) Traveller Conduct

You agree to behave respectfully towards guides, staff, and other trekkers.

We reserve the right to remove a traveller from a trek (without refund) if their conduct:

  • puts others at risk
  • violates local laws
  • is aggressive, unsafe, or disruptive
  • refuses reasonable safety instructions

8) Health & Altitude Risk

High-altitude trekking carries inherent risks, including altitude sickness, injury, and medical emergencies.

You acknowledge that:

  • acclimatisation is essential and may require schedule adjustments
  • guides may alter plans to protect health and safety
  • you may be required to descend if symptoms arise

If you choose to ignore safety guidance, you assume responsibility for the consequences.

9) Travel Insurance

Travel insurance that covers:

  • high-altitude trekking
  • emergency evacuation
  • trip interruption
  • medical care

is strongly recommended and may be required prior to departure. Insurance is the traveller’s responsibility.

10) Third-Party Services

Some services (flights, hotels, transport providers, payment gateways) are provided by third parties.

We are not responsible for delays, cancellations, or failures caused by third parties, though we will assist reasonably with coordination where possible.

11) Website Use

You agree not to:

  • misuse or disrupt the website
  • attempt unauthorized access
  • upload malicious code
  • use the website for unlawful purposes

All site content (text, images, branding) is owned by Resurgence Treks or used under license and may not be reproduced without permission.

12) Limitation of Liability

To the maximum extent permitted by law:

  • Resurgence Treks is not liable for indirect or consequential losses.
  • Participation in trekking activities is at the traveller’s own risk.
  • Liability is limited to the amount paid for the services, except where prohibited by law.

Nothing in these Terms excludes consumer guarantees or liabilities that cannot legally be excluded.

13) Privacy

Use of this website is also governed by our Privacy Policy, which explains how we collect and handle personal data.

14) Governing Law

These Terms are governed by the laws applicable to the operating location of the trek services (Nepal), unless consumer laws in your home jurisdiction require otherwise.

15) Changes to These Terms

We may update these Terms periodically. Updates will be posted on this page with an updated effective date.
